STEPS FOR COMPETITON REGISTRATION

1. REGISTER HERE BY FOLLOWING THESE STEPS
2. THERE IS A REGISTRATION FEE OF $50 TO ENTER (the registration fee includes your entrance fee and our signature CURVY BOLD CONFIDENT & BEAUTIFUL T-SHIRT (shirt will be shipped after October 30, 2021, when competition closes).
3. BOTH THE REGISTRATION FEE AND REGISTRATION INFORMATION FORM MUST BE COMPLETED FOR YOU TO BE  COMPLETELY REGISTERED.
4. YOU MUST FOLLOW US ON INSTAGRAM @smoochesmovement
5. ALL ENTRIES MUST BE COMPLETED AND UPLOADED BY OCTOBER 30, 2021 (DEADLINE DATE EXTENDED TO NOVEMBER 5, 2021 ) 

SWM COVER GIRL COMPETITION RULES:

1. THIS COMPETITION IS OPEN TO WOMEN WHO ARE 18 YEARS OR OLDER, PLUS SIZE/CURVY WOMEN (SIZE 10 OR UP ) AND RESIDE IN THE UNITED STATES. PLEASE SEE FURTHER ELGIBILITY REGISTRICTIONS BELOW. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY APPLICABLE LAW.

SWM OFFICIAL RULES

1. By entering this “Smooches Woman Magazine Cover Girl Competition” (the Competition), individuals submitting registered entries (each an “Entrant” and collectively, the “Entrants”) accept and unconditionally agree to be bound by these Official Rules (the “Rules”). Selected Judges will choose the winning entry and a Grand Prize will be awarded in accordance with these Rules. Any violation of the Rules can, at Sponsor’s discretion, result in disqualification. All decisions of Sponsor regarding this Competition are final and binding in all respects. 
2. CONSUMER DISCLOSURE: You have not yet won.
3. Sponsor. The Competition is sponsored by Smooches Woman Magazine (“Sponsor”), who is owned and operated by Acereel Studio, LLC.
4. Eligibility. All Entrants must be women who are eighteen (18) years or older and was 18 years or older in all the Submitted Photographs (defined below), plus size/curvy women who wear a clothing size 10 and up. Entrants must be of a legal resident and live in the United States. Void where prohibited or otherwise restricted by applicable law. Employees of Smooches Woman Magazine, Acereel Studio, LLC and its and their respective parent companies, subsidiaries, affiliates, and their advertising and production companies and any family member are ineligible to participate.
5. How to enter. Complete and submit your official entry form and pay the registration fee. You must be actively following us on our official Instagram Page @SmoochesMovement and provide all information requested including three (3) recent and different photographs of yourself that meet the specifications required below (the “Submitted Photographs”) using the upload tool and instructions provided and a 500 word or less essay which explains why you should be the next cover girl of SWM.  
6. Only the Entrant should appear in the Submitted Photographs. All Submitted Photographs must have been taken on or after Entrant reached eighteen (18) years of age.   Submitted Photographs must not infringe or violate any right of any third party or entity, including but not limited to copyright, right of publicity, and right of privacy. Please check with the photographer for any professional photos to make sure that you have the rights to submit the photographs. Any Submitted Photographs exhibiting nudity, will be automatically rejected. The determination of whether any image exhibits nudity is in the sole discretion of Sponsor. False, deceptive, or incomplete entries or other information provided by Entrants though the Competition may render the entry ineligible at any point in the Competition regardless of when the problem is discovered.
7. Sponsor reserves the right to contact an Entrant to request resubmission of one or more of the Submitted Photographs and/or to request that the Entrant submit additional photos. While Entrants may have assistance in entering the competition online and uploading the photographs, each Entrant must otherwise complete the entry form herself. Any entries submitted by anyone other than the person appearing in the Submitted Photographs (including but not limited to entries submitted by modeling agencies and or photographers) will be rejected. As set forth in greater detail below, submission of photographs and entry in the Competition constitutes consent to the use of the Submitted Photographs in SWM advertisement, which includes digital & social media, websites and otherwise in connection with the Smooches Movement brand, and in any and all media now known or hereafter discovered for the full duration of the copyright in the applicable Submitted Photographs. By entering the Competition, Entrant represents and warrants that she is eighteen years of age and owns or controls all necessary rights in the Submitted Photographs to grant Sponsor the rights described herein.
8. Submission of a qualifying entry grants Sponsor and its representatives and agents the right to publish, use, adapt, edit, and/or modify such entry in any way, in any and all media, without limitation and without consideration to Entrant. Submission of an entry further constitutes Entrant’s consent to irrevocably assign and transfer to Sponsor all rights, title, and interest in the entry, including, without limitation, all copyrights reserved.
9. Except as otherwise permitted herein, only one entry per person will be accepted; all subsequent entries will be disregarded. Entrants may submit their entry forms and photographs using the above procedures anytime during entry period. No Late Entrants received after the submission closing date will not be accepted.

 

1. Competition rounds: Preliminary Round 1, Round 2 and Round 3 (see descriptions defined below)
2. Preliminary Round. During the Preliminary Period (Round 1), Judges will evaluate submitted photos based on photogenic qualities (overall photo, personality and posing ability) and the 10 Entrants with the highest scoring points will move forward to Round 2.
3. Round 2. For round 2, Entrants will be judged on their written essay submission to the competition question “Why should you be SWM’s next Cover Girl”. Judges will evaluate each Entrants written submission that made it to this round and the 5 candidates with the highest score will make it to Round 3.
4. Round 3. One of your original submitted photos will be used to create a mock SWM cover and put-on Instagram. This round is a two-step process. Step one, your supporters will need to follow the Smooches Movement IG page and Step two, your supporters will need to place a vote by liking their favorite Cover Girl Photo. It's very important for your supporters to follow the rules or their vote may not be counted. Candidates will receive (5) points for every 100 likes they receive from followers.
5.  Winner Decision. The winner will be the Candidate that has the highest score overall for all three rounds combined (Preliminary Round 1, Round 2 and Round 3). The candidate with the highest score will be our Grand Prize Winner.
6. Grand Prize. The Grand Prize winner will win a professional photoshoot and appear on the cover of Smooches Woman Magazine (SWM) and have an inside spread of our November 2021 Issue.
7. The winner will also receive a SWM winner’s basket filled with Smooches Brand Merchandise.
8. The Grand Prize Winner must be available for the cover photo shoot on one of these possible photo shoot dates (November 20th or November 21st).  The specific shoot date and location of shoot to be determined. If Grand Prize Winner lives within 400 miles from our corporate headquarters (Acereel Studio, LLC 827 Glenside Ave, Wyncote Pa 19095), the winner will be required to travel to our headquarters for the cover shoot. If the winner lives further than 400 miles, we may sub-contract the photo shoot to a photographer within close proximity of the winner or cover the cost for the winners traveling & lodging expenses to come to our headquarters.
9. Verification of winner. Winner will be required to sign affidavit of eligibility, a liability/publicity release and other competition documents. If any potential winner fails or refuses to sign and return all required documents, the winner may be disqualified and an alternate (the next candidate with highest score) winner will be selected. By accepting the Grand Prize, the Winner agrees to maintain her behavior in accordance with all applicable laws and generally accepted social practices while participating in any competition activity.  The Winner understands and further agrees that Sponsor has the right, in its sole discretion, to disqualify and remove the Winner from any activity at any time if Sponsor determines that the Winner’s behavior at any point is disruptive, inappropriate,  or cause damage to person, property, or the reputation of Sponsor.
10. DISCLAIMER AND RELEASE OF LIABILITY. SPONSOR, SMOOCHES WOMAN MAGAZINE AND ACEREEL STUDIO, LLC PROMOTION ENTITIES, AND ARE NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE ENTRY INFORMATION, HUMAN ERROR, TECHNICAL MALFUNCTION, FAILURES, OMISSION, INTERRUPTION, DELETION, OR DEFECTS OF ANY COMPUTER ONLINE SYSTEMS, COMPUTER EQUIPMENT, SERVERS, ACCESS PROVIDERS, OR SOFTWARE, INCLUDING ANY INJURY OR DAMAGE TO PARTICIPANTS OR ANY OTHER PERSONS’ COMPUTER RELATING TO OR RESULTING FROM PARTICIPATION IN THIS COMPETITION; INABILITY TO ACCESS THE ENTRY WEBSITE OR ANY PAGES THEREOF; THEFT; TAMPERING; DESTRUCTION; OR UNAUTHORIZED ACCESS TO, OR ALTERATION OF ENTRIES; ENTRY SUBMISSIONS THAT ARE PROCESSED LATE OR INCORRECTLY OR ARE INCOMPLETE, GARBLED, OR LOST DUE TO COMPUTER OR ELECTRONIC MALFUNCTION OR TRAFFIC CONGESTION ON THE INTERNET OR ANY WEBSITE. PROOF OF ENTERING INFORMATION ON THE WEBSITE IS NOT CONSIDERED PROOF OF DELIVERY OR RECEIPT. ALL DATES SET FORTH IN THESE OFFICIAL RULES ARE APPROXIMATE. SPONSOR RESERVES THE RIGHT TO EXTEND ANY DEADLINES. ALL ENTRIES AND ANY OTHER MATERIALS SUBMITTED (INCLUDING BUT NOT LIMITED TO THE SUBMITTED PHOTOGRAPHS) BECOME THE SOLE PROPERTY OF SPONSOR AND WILL NOT BE RETURNED OR ACKNOWLEDGED. FALSE AND/OR DECEPTIVE ENTRIES OR ACCOUNTS SHALL RENDER ENTRY INELIGIBLE.
11. ALL DECISIONS OF SPONSOR SHALL BE FINAL AND CONCLUSIVE ON ALL MATTERS RELATING TO THE COMPETITION.
12. ALL ENTRANTS, SELECTED ENTRANTS, AND THE GRAND PRIZE WINNER RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS SPONSOR, PROMOTION ENTITIES, AND ALL PRIZE PROVIDERS, AND THE OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS OF EACH, FROM AND AGAINST ANY AND ALL LIABILITY WITH RESPECT TO, OR IN ANY WAY ARISING FROM, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, THIS COMPETITION, PUBLICATION OR USE OF THE SUBMITTED PHOTOGRAPHS OR ADDITIONAL PHOTOGRAPHS, ENTRANTS’ NAMES AND LIKENESSES, AND/OR ACCEPTANCE, USE, MISUSE, LOSS, OR MISDIRECTION OF THE PRIZE, INCLUDING LIABILITY FOR PERSONAL INJURY, DEATH, DAMAGES, OR MONETARY LOSS.
13. IN NO EVENT SHALL SPONSOR, PROMOTION ENTITIES, OR ANY PRIZE PROVIDER BE LIABLE OR OBLIGATED TO AN ENTRANT, SELECTED ENTRANT, GRAND PRIZE WINNER, OR ANY THIRD PARTY IN ANY MANNER FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES OF ANY KIND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT PRODUCT LIABILITY, OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGES IN ADVANCE. THIS SECTION SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND NOTWITHSTANDING THE FAILURE OF ANY LIMITED REMEDY.
14. ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION, OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUG RESORT TO ANY FORMOF CLASS ACTION; AND ANY AND ALL CLAIMS, JUDGEMENTS, AND AWARD SHALL BE LIMITED TO ACTUAL OUT OF POCKET COSTS INCURRED, EXCLUDING ATTORNEY’S FEES AND COURT COSTS.
